1. Scope and parties
These terms govern services provided by Mumbocetra GmbH, Neubaugasse 40, 1070 Wien, Austria («we», «studio»), trading as Mumbocetra recording studio. Contact: 01 966 12 34, [email protected], contact form.
A consumer is any natural person acting mainly outside their trade or profession. Any other client is a business customer. Your own terms apply only if we confirm them in writing.
The contract consists of the accepted quote, these terms and — where a business client sends us third-party personal data — the data processing agreement. Processing of personal data is explained in the privacy policy.
2. Definitions
| Term | Meaning |
|---|---|
| Quote | Written description of services, date, price and deposit. |
| Session | Reserved studio time or agreed remote production window. |
| Services | Recording, mixing, mastering, podcast production and related work listed under Services. |
| Deposit | 30% of the agreed total price to hold the date. |
| Business day | Monday to Friday, excluding public holidays in Vienna. |
3. Pre-contract information
Before booking, the website, service pages and your quote describe essential features, total price, dates, our identity and — for consumers — withdrawal information. Indicative rates (for example €115 per hour for Band in the live room or €255 for Podcast & talk) are non-binding until confirmed in the quote.
4. Quotes and formation of contract
We usually respond to enquiries via Contact, phone or email with a quote within 2 business days. Quotes stay open for 2 business days unless another date is stated. The contract is formed when you accept the quote in writing (email is enough) and the deposit reaches us. Until then, the slot may be offered to others.
For distance contracts we confirm the booking on a durable medium (email) with the quote details.
5. Prices and tax
Prices on the website and in quotes are in euros and include 20% VAT unless marked net. Net amounts for business clients are available on request (example net hourly rate for Vocals & singing: €81.67).
Extra time beyond the booked slot is charged only with your prior consent, pro rata to the quote. Add-ons (such as an extra master at €99) are billed only when agreed in writing.
6. Deposit and payment
A deposit of 30% of the total price is due to reserve the date. It is credited against the balance. Pay by bank transfer or, by arrangement, by card on site. Consumers pay the balance on the service date or, for remote work, when agreed export files are delivered.
Business clients receive 14 days from invoice date. Late payment may attract statutory interest and reminder costs. Until full payment we may withhold final mix or master files; raw material is archived as under archiving.
7. Reschedule and cancellation by you
| Notice before session | Effect |
|---|---|
| More than 4 calendar days | Free reschedule or cancellation; deposit refunded if you cancel. |
| 4 days or less | Deposit retained as a flat effort fee unless the slot is re-sold; one reschedule within three months by agreement. |
| No-show | Full agreed session price due where mandatory consumer law allows. |
Notify us in writing. Lateness on the day shortens usable time if the next booking is taken. These rules do not limit any statutory right of withdrawal.
8. Right of withdrawal (consumers)
Consumers who conclude a distance or off-premises contract may withdraw within 14 days of conclusion under Austrian distance selling rules (FAGG), unless an exception applies.
If you ask us to start before the period ends, we need your express consent; if you withdraw after work has begun, you pay a fair share for services already supplied. The right expires once the service is fully performed if you agreed to early performance and acknowledged that you lose the right when complete. It may also not apply to custom audio production once execution has begun with your cooperation.
Send withdrawal to Mumbocetra GmbH, Neubaugasse 40, 1070 Wien, or [email protected]. Sample form:

9. Running sessions
Opening hours: Tuesday–Friday 9:00–20:00, Saturday 10:00–16:00. Closed Sunday and Monday.. Directions: Take U-Bahn line U3 to Neubaugasse; from there it is about a 4-minute walk along Neubaugasse. Tram lines 49 and 13 also stop at Neubaugasse or Siebensterngasse, each a short walk away. From Wien Westbahnhof, U3 is one stop towards Simmering.. The studio has 3 rooms, including a live room of about 44 m² and 1 iso booth. Podcast setups seat up to 4 people.
Participants from age 16 are welcome; minors need consent from a parent or guardian who books and pays. Treat rooms and gear with care and follow engineer instructions. No smoking or vaping indoors. We may stop a session if people or equipment are at risk; fees may then reflect work done.
We keep listening levels moderate and offer breaks and hearing protection. See band scheduling guide for timing tips.
10. Files, delivery and archiving
Unless agreed otherwise, we deliver exports in common formats (typically 24-bit WAV) via download link or your drive. Deadlines for Stem mixing and Mastering start when complete, usable material is received.
We keep project files and session backups for 24 months after the last service, then delete them unless a longer period is agreed in writing. You remain responsible for your own backups. Extended archiving can be quoted separately.
11. Revision rounds
Mix and master work includes 2 revision rounds as bundled feedback. Further rounds or a new artistic direction after sign-off are quoted separately. Recording sessions do not include unlimited editing unless stated in the quote.
12. Copyright and usage
Your works. Music, lyrics and samples you provide remain yours. You warrant that you hold the necessary rights and handle collective management or licensing duties yourself.
Recordings and files. You are the economic rights holder in recordings you finance unless agreed otherwise. On full payment we grant the usage needed to exploit the delivered exports; internal portfolio use by the studio requires your written consent.
Performers. Obtain performer consent where required (see guest releases). We do not train AI on your recordings or clone voices without separate written permission.
13. Liability
We work to professional audio standards; artistic results also depend on your preparation and are not guaranteed. For slight negligence we are liable only for breach of essential duties and foreseeable damage. Liability for intent, gross negligence, personal injury and mandatory statutory liability is unaffected.
For business clients total liability per project is capped at the agreed total price except for personal injury. Gear you bring remains your responsibility unless we act with gross negligence. Non-contractual website notes: disclaimer.
14. Warranty
Consumers have statutory warranty rights for defective services. Report obvious technical defects in delivered files (such as dropouts from export errors) promptly; we will remedy justified defects by correction or re-delivery. Taste-based mix comments are not an unlimited rework obligation beyond agreed revision rounds.
15. Force majeure
Neither party is liable for delay caused by events beyond reasonable control (power failure, pandemic, official closure). The affected party informs the other without delay. Sessions are rescheduled where possible; if performance becomes permanently impossible, amounts paid for undelivered work are refunded.
16. Privacy
We process personal data under the privacy policy. The contact form uses FormSubmit (USA) with safeguards described there. Business clients sending guest or musician data may need a data processing agreement. Cookie choices: .
17. Dispute resolution
Contact [email protected] first to resolve issues. Consumers may use the EU ODR platform. We do not participate in consumer arbitration boards; independent advice is available from bodies such as the Vienna Chamber of Labour and the Austrian Consumer Association (VKI).
18. Governing law and jurisdiction
Austrian substantive law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory protections in a consumer’s EU home country remain where applicable.
Place of jurisdiction for disputes with business clients is the competent court in Vienna. Consumers may also sue at their place of residence.
19. Final provisions
If any clause is invalid, the rest remains effective and is replaced by a valid rule closest to the economic purpose. We may update these terms with date 15 October 2026; the version at quote acceptance controls. If translations differ, the German text prevails. Further questions: FAQ or About.
